Consumer Health Data Privacy Policy

This policy explains how Zirv handles consumer health data as defined in the Washington My Health My Data Act (RCW 19.373), Nevada Senate Bill 370 (2023) and the Connecticut Data Privacy Act. It supplements our Privacy Policy, which describes all of our processing of personal data.

Consumer Health Data We Collect

Depending on the features you use, we collect:

  • Heart rate, energy burned, cadence and other sensor data, read with your permission from Apple Health, Apple Watch or a Bluetooth heart rate sensor
  • Workout and activity data, such as exercises, sets, repetitions, weights, duration, distance, pace and GPS routes
  • Body measurements, such as body weight and body fat, and progress photos you choose to add
  • Nutrition data, such as the foods you log, your calorie and macronutrient intake and your nutrition targets
  • Fitness goals and training preferences
  • Motion data used for automatic workout detection in the iOS app, which is processed on your device

Why We Collect and Use It

We use consumer health data to provide the features you ask for: tracking your workouts, activities and nutrition, showing your progress and statistics, making training suggestions, syncing your data between your devices, and showing other users the content you choose to share. We also use it as needed to keep the Service secure and to comply with the law. We do not use consumer health data for advertising, and we do not sell it.

Where We Get It

  • From you, when you enter data in the app or on our website
  • From your devices and connected services, with your permission: Apple Health, Apple Watch, Bluetooth heart rate sensors, and your phone's motion and location sensors
  • From Open Food Facts, which provides product information (not information about you) when you scan a barcode

Who We Share It With

We share consumer health data only:

  • With Hetzner Online GmbH, which hosts our servers and databases on our behalf
  • With other users, when you choose to share workouts, posts or other content through community features
  • With Apple Health on your own device, if you allow the iOS app to save workouts there
  • With authorities, when the law requires it

Your Rights

Depending on where you live, you have the right to confirm whether we collect, share or sell your consumer health data; to access it, including a list of the third parties we have shared it with; to withdraw your consent; and to have it deleted. We will not discriminate against you for exercising these rights.

You can delete data in the app, delete your account, or download a PDF summary of your data in your account settings. To receive a complete copy in a structured, machine-readable format (JSON), email josj@zirv.io and we will provide it within one month. You can make any other request by emailing josj@zirv.io. We will respond within 45 days. If we need more time, we may extend this once by another 45 days and will tell you why.

Appeals

If we decline to act on your request, you can appeal by replying to our decision or by emailing josj@zirv.io with the subject "Appeal". We will respond in writing within 45 days and explain our decision. If we deny your appeal, you can complain to the Attorney General of your state, for example the Washington State Attorney General at atg.wa.gov.
